Illinois E-waste Law
Update: The current e-waste law has been amended with the passage of HB 5907.
SB 2313, The Electronic Products Recycling and Reuse Act, was enacted on September 17, 2008 and came into effect on January 1, 2010. This law requires manufacturers to finance and implement a recycling program to accept e-waste from consumers.
Numbers
Illinois collected 32,921,667 pounds of electronic products for its first year, exceeding the statewide recycling goal of 31 million pounds.
Details
Over the next few years, the law's recycling requirements will gradually come into effect. The legislation only applies to electronic equipment taken out of use from residences, but it affects many of the businesses involved in the stream of electronic commerce.
Manufacturers must register with Illinois Environmental Protection Agency and disclose whether their products are RoHS compliant. There is a civil penalty of up to $10,000 for each day of violation. There is prohibition on using prison labor.
Disposal Ban:
Disposal of certain e-waste in municipal waste and sanitary landfills and at incinerators will be prohibited starting 2012 and beyond.
Covered Devices: Desktop computers, notebook computers, computer monitors, printers and televisions.
The following products may also be collected and count toward an manufacturer's annual recycling goal: mobile telephone, computer cable, keyboard, mouse, stand alone facsimile machine, MP3 player, portable digital assistant (PDA), video game console, video cassette recorder/player, video disk player, zip drive and scanner.
