National Bottle Bill Campaign: HR 2046: Bottle Recycling Climate Protection Act of 2009
 

Summary

HR 2046 would make bottle deposits mandatory nationwide.

The Act would initially add a five-cent deposit to the price of each applicable container. Any retailer who sells or has recently sold the same brand of beverage in the same kind and size package would be required to accept empty, unbroken returns and refund the deposit money.

Certain states are exempted from the new national bottle bill if:

  • They already have a deposit law in effect (allows exemption for 3 years following enactment) OR
  • They already have a high beverage container recycling rate (50% the first three years the law is in effect, increasing to 70% by the fifth year) OR
  • They have a law requiring a minimum 70% recovery rate.

Status

Apr 23, 2009: Referred to the Subcommittee on Energy and Environment.

This bill never became law.
